TOPLEVELTENNIS.COM S.A. Privacy Policy

 

TOPLEVELTENNIS.COM S.A. respects and observes the Users’ right to privacy. Below you will find information relevant to the Users on how information about the Users of the topleveltennis.com Portal (the Portal) is collected, processed and used and how TOPLEVELTENNIS.COM S.A. protects personal data of their Users with appropriate technological solutions.

Any terms used herein shall have the same meaning as those ascribed thereto in the Terms and Conditions for the provision of electronic services by TOPLEVELTENNIS.COM S.A. on the topleveltennis.com Portal.

In compliance with the information obligations set out in Article 13 of the General Data Protection Regulation of 27 April 2016, 2016/679 the controller of personal data shall provide the following information:

  1. full name and contact details of the controller,
  2. the purpose and legal basis for processing personal data,
  3. the type of legitimate interest pursued by the controller,
  4. information on the categories of recipients of personal data and the possibility of transferring personal data to a third country,
  5. the storage period of personal data and the criteria for determining the duration thereof,
  6. information on the right to request the controller to access, rectify, erase or limit the processing of personal data concerning the data subject or the right to object to the processing, as well as on the right to data transfer,
  7. information on the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before the withdrawal,
  8. information on the right to lodge a complaint with the President of the Personal Data Protection Office,
  9. information whether the provision of personal data is a statutory or contractual requirement or a condition for the conclusion of a contract and whether the data subject is obliged to provide it and what are the possible consequences of not providing the data,
  10. information whether the automatically collected personal data can be used for profiling.

For the purpose of providing services in the Portal, personal data of the Users are processed, provided or made available by the Users in their browsing history and web applications as part of using the Services. The Users provide personal data necessary to provide services, for example, when creating a User Account or data changed when editing the Account (such as: first and last name(s), PESEL number and, if PESEL is not available, identity card number, passport number or any other identity document, residence address and e-mail address). The data collected during the User’s activity in the Portal are also processed, among others: the pages visited, the manner in which the User uses the Services (for example, searching for Materials), information about the terminal equipment or browser, including its location. Processing of the above-mentioned data is necessary due to the properties of electronic services. Additionally, the Portal also collects information contained in system logs (e.g. IP address). These are used for technical purposes related to server administration.

Your personal data are processed pursuant to Article 6(1)(a), (b), (c) and (f) of the General Data Protection Regulation of 27 April 2016 2016/679 i.e.:

  1. the consent given,
  2. the need to perform a contract or to take action before concluding a contract,
  3. to fulfil the legal obligation of the controller,
  4. necessary for purposes resulting from legitimate interests pursued by the controller or by a third party.

The data shall be processed for the following purposes:

  1. conclusion and implementation of the contract for the provision of services by electronic means with TOPLEVELTENNIS.COM S.A,
  2. provision of the newsletter service free of charge,
  3. optimizing and increasing the efficiency of services provided by TOPLEVELTENNIS.COM S.A,
  4. fulfilling the legal obligation imposed on TOPLEVELTENNIS.COM S.A,
  5. archiving,
  6. seeking claims,
  7. making personal data available to third parties cooperating with TOPLEVELTENNIS.COM S.A. in order to provide services for TOPLEVELTENNIS.COM S.A.

TOPLEVELTENNIS.COM S.A. commissions the processing of personal data to entities that support TOPLEVELTENNIS.COM S.A. in the provision of services and that ensure confidentiality and information security using appropriate personal data protection measures. Such commissioning of personal data processing is based on a lawful written agreement. Without a legal basis, the collector shall not transfer (nor sell or lend in any way) the collected personal data of Portal Users to third parties. The User’s personal data may also be made available to entities authorised to obtain them on the basis of the applicable law (for example, law enforcement agencies). To the extent permitted by the applicable law, the data may be made available to debt collection and debt trading institutions.

Your personal data may be transferred to third countries, including the USA in the event that the www.topleveltennis.com website uses tools such as Google Analytics, PayPal, etc., and in the event of logging in using Facebook and Google+ portals (and the likes) to sites where you make your personal data available to TOPLEVELTENNIS.COM S.A.

The period of storage of personal data depends on the type of data and the purpose wherefor it is processed:

  1. for the performance of the contract – 7 years from its conclusion,
  2. for the purpose of providing a free newsletter service – until withdrawal of consent,
  3. for other purposes – for the period required to protect the collector’s security and legitimate interests and justified by the fulfilment of legal obligations of the collector.

You have the right to:

  1. demand access to your personal data from the controller,
  2. request their correction, removal or restriction of processing,
  3. object to the processing,
  4. data transfer.

For that purpose you have to contact the collector sending an e-mail to the following address: office@topleveltennis.com. The user has the right to access and correct their personal data through his User Account. By completely deleting your email address, you are deleting your User Account, which requires you to check the “Delete Account” option in your User Account. Complete deletion of your e-mail address submitted for the purpose of receiving the Newsletter requires connecting to the website topleveltennis.com using the Internet address (link) specified at the end of each message sent as part of the newsletter service. For security purposes, if there is a suspicion that the User Account may have been violated, e.g. through unauthorized access to the login and password used to log in to the Portal, the User shall immediately contact the Portal’s administrative staff at the following e-mail address: office@topleveltennis.com.

The collector shall, without undue delay, and in any case within one month from the receipt of the request, provide the data subject with information about actions taken in connection with the exercise of the aforementioned rights. The controller may extend the deadline by another two months due to the complicated nature of the request or the number of requests. Within one month from the receipt of the request, the controller shall inform the data subject about such extension of the period, giving the reasons therefor. The data subject shall have the right to choose the form of communication, including electronic form.

If the controller fails to act on the request of the data subject, the controller shall immediately and at the latest within one month from the receipt of the request, inform the data subject of the reasons for the failure to act and of the possibility of lodging a complaint to the supervisory authority and seeking judicial remedies.

Communication and action taken under this privacy policy shall be free of charge. If the data subject’s requests are unfounded or excessive, in particular because of their continuous nature, the controller may:

  1. charge a reasonable fee, taking into account the administrative costs of providing information, communication or taking the requested action or,
  2. refuse to act on the request.

You have the right to revoke your consent to the processing of personal data at any time. However, this does not affect the legality of the processing that was carried out on the basis of your consent before it was revoked.

Every User has the right to lodge a complaint with the President of the Personal Data Protection Office.

The provision of personal data is voluntary, but failure to do so will make the conclusion of a contract and use of other services impossible. Providing the User’s e-mail address is necessary to register the User Account and use the Newsletter service. In order to facilitate the use of some of the services available on the Portal, the forms proposed on dedicated pages may indicate other personal data, the provision whereof is necessary to use the service proposed on the Portal. To this end, the User agrees to the processing of personal data for the purpose of using certain services, which means that the legal basis for the processing is Article 6(1)(a) of GDPR. The data provided are protected against access by third parties and used by TOPLEVELTENNIS.COM S.A. exclusively for contacting with Users necessary for the performance of a given service.

The collected personal data is treated as a database with a high level of security, stored on a server secured both against remote (IT) and physical access. TOPLEVELTENNIS.COM S.A. has implemented appropriate technical and organizational measures to ensure a degree of security corresponding to the risk of violation of rights and freedoms of their Users. Moreover, all persons processing Users’ personal data for the purposes of the Portal have appropriate authorisations issued by the collector of personal data in accordance with Article 29 of GDPR.

TOPLEVELTENNIS.COM S.A. does not collect specific personal data, including sensitive, racial, religious and political data. The data collected are of an informative nature and it is not possible to identify the user directly thereby.

Attachment to the Privacy Policy – Cookies Policy

By using the Portal and configuring the browser settings, the User agrees that TOPLEVELTENNIS.COM S.A. may use cookies and other similar technologies. The consent to the use of cookies and similar technologies is voluntary, but failure to give such consent will not reduce the number of advertisements received by the User, but only reduce their relevance in relation to the User’s interests and expectations.

Personal data collected automatically by means of cookies and similar technologies are not used by TOPLEVELTENNIS.COM S.A. for profiling, but may be used for profiling by other controllers cooperating with TOPLEVELTENNIS.COM S.A.

Cookies are a form of communication between the browser and the IT system. They are small pieces of information that are stored on the User’s terminal equipment for identification purposes, but they do not allow to directly identify such individual. Information collected using cookies support the functioning of a number of Internet mechanisms, such as:

– making purchases online,

– collecting statistics on website visits,

– identification or time spent on the site,

– supporting the display of advertisements.

Cookies are only available on specific sites and it is not possible to download cookies that do not belong to a particular site.

By using cookies, the data on Users’ activity within the services whereto a counting system is attached, are collected. The collected data pertain to the frequency of visits, categories and subject matter of visited pages, in specific cases of clicking on ads or viewing them, searching for data within websites, technical data about the browser and operating system, geolocation, demographic and personal data. The Controller does not collect, use or process sensitive personal data (such as data relating to religion, political opinions, health, etc.) , nor any data that comes from sites created for children.

The cookies are used for the following purposes:

1) to make the websites on the Portal work faster and be easier to use,

2) to better match the content and advertisements available in the Portal to the User’s expectations and interests,

3) to facilitate the presentation of advertisements in the Portal that are tailored to the User’s interests,

4) to collect aggregated statistics that allow us to understand how Users use the Portal and help us to improve the functionality and content of the Portal.

TOPLEVELTENNIS.COM S.A. uses the following types of cookies:

1) session cookies (remaining on the device only while using the Portal) and permanent cookies, which remain on the device for a predetermined time of existence or until their removal;

2) authentication (to identify the logged in User in order to display the matching information);

3) security (supporting the mechanisms preventing abuse of the Portal’s pages);

4) necessary for the operation of the Portal (optimizing the use of the Portal, for example by remembering previous actions);

5) functional (responsible for remembering the User’s settings and choices in order to provide tailored content and services);

6) advertising (in order to provide advertisements corresponding to the activity on the Portal, while limiting the provision of mismatched advertisements).

The User may agree to store cookies coming from the Portal in his device by changing software settings installed in the device he uses, e.g. laptop, tablet, smartphone. By default, web browsers allow storing cookies on the device used by the User. You can change the settings for cookies at any time.

The User who does not agree to the use of cookies or other similar technologies or wants to limit the acceptable use of cookies should change the browser settings or resign from using the Portal. The User can change the settings of his browser so that cookies are blocked, in whole or in part, for example, only from third parties, or to receive a message every time cookies are sent to the User’s device. Changing the cookie settings and similar technologies may affect the way the Portal functions. The Portal may contain redirections to websites owned and operated by external entities (such as Facebook, YouTube, Twitter or Instagram). These third-party websites have their own privacy policies and probably use cookies, so it is worth remembering to read their privacy policies as well. TOPLEVELTENNIS.COM S.A. is not responsible for the content of cookie files sent by other websites to which links are placed on the websites of the Portal.

Using the Portal, the User may receive cookies from entities that support TOPLEVELTENNIS.COM S.A. in the provision of services. These entities have their own privacy policies and may use cookies. TOPLEVELTENNIS.COM S.A. is not responsible for the content of cookie files sent by other websites to which links are placed on the websites of the Portal.

Some information from cookies stored on the device of the Portal User are made available to other entities cooperating with TOPLEVELTENNIS.COM S.A. within the scope of advertising services offered on the Portal. The purpose of making this information available to them is to keep track of statistics of advertisement displays and clicks in order to enable monitoring the effectiveness of advertisements.

TOPLEVELTENNIS.COM S.A. uses third party analytic software (e.g. Google Analytics, Facebook Pixel) which stores codes in the User’s terminal equipment that enable the collection of data about Users. If the User does not agree to the use of their personal data to improve the quality of the Portal’s functioning, they should open the appropriate privacy tool and use the options provided for managing privacy settings.

 

This Privacy Policy may be amended. In such case all Users will be informed about it in advance through email or on website http://www.topleveltennis.com.
